近年来,随着生活水平的提高,人们更加追求饮食的营养、健康.而食品添加剂在我国还是新兴行业,众多消费者对食品添加剂的基本常识不太了解,自然会产生一些疑惑,甚至非议.这就需要我们不断地用科学的态度,公正地宣传食品添加剂的知识,使公众能够正确地认识和理解使用食品添加剂的合理性和必要性.从科学的角度来看,绝大多数食品添加剂的使用并不会影响食品安全,而非法使用非食品添加剂或违规过量使用个别食品添加剂,则会影响食品安全,因此做好食品添加剂的管理和监督工作是十分必要的.本文首先从食品安全的概念切入,分别阐述了“食品”、“安全”的含义,明确了食品安全与食品卫生、食品质量的不同.我国食品安全的现状以及食品安全自身所具有的属性决定了必须由法律对其加以规制,而就我国相关法律规制状况来说,仍然存有很多缺陷,主要是相关法律法规缺乏统一性、协调性,多头执法、监管权责不明.对我国食品安全法律规制的缺陷分析之后,提出本文要解决的问题——完善我国相关法律,这也是本文研究的主要目的.

In recent years,with the improvement of living standards,people are more pursue at the nutrition and health of diet.Because of the food additives is a new industry in China,many consumers are not understand the basic knowledge of food additives,so they confuse about it or even criticize it.Therefore,we need to continually propaganda the knowledge of food additives impartially with scientific attitude,to make public correctly understand the rationality and necessity of using food additives.From the view of science,the majority ues of food additives will not affect the safety of food,but it is not including illegal or excessive use of food additives.So it is very necessary to do a good work in management and supervision of food additives.This thesis explan the concept of food safety,expound the meaning of "food" and "security" respectively,definite the difference between safety,hygiene and quality of food.Chinese law should make some provision for food safety which has determined by it's present situation and properties.In fact,there are still a lot of flaws of the relevant laws and regulations in China.It is mainly due to the lack of unity and compatibility of related laws and regulations,duplicate law enforcement,and ambiguity of power and duties.After analysis the flaws of food safety laws and regulations in our country,raising the problem,which would be solved in this thesis,perfecting the relevant laws in our country.This is the mainly purpose of research in this thesis.
