Bills of lading are normally issued in sets of three and a forth copy is kept by the ship’s master.When one copy is handed over to claim possession of the goods the other copies is void.A bill of lading is a documents of title unlike an air waybill or railway consignment note,and as such is a vital document to a banker who is handling the documents and has advanced money against them or has accepted or negotiated a bill of exchange in respect of the transaction.
The risk of loss of or damage to the goods,as well as the obligation to bear the costs relating to the goods,passes from the seller to the buyer when the seller has fulfilled his obligation to deliver the goods.Since the buyer should not be given the possibility to delay the passing of the risks and costs,all terms stipulate that the passing of the risks and costs may occurred even before delivery,if the buyer does not take delivery as agreed or fails to give such instructions (with respect to time for shipment and/or place for delivery ) as the seller may require in order to fulfill his obligation to deliver the goods.It is a requirement for such premature passing of risk and costs that the goods have been identified or intended for the buyer or,as is stipulated in the terms,set aside for him (appropriation).
Should any damage be incurred,the insured would within 60 days after the arrival of the consignment,file a claim,supported by survey report,with the insurance agent in his city and ask them to compensate him for the losses according the risks insured.
The bill of lading is partly a receipt for the goods singed by a ship’s officer and returned to the exporters.
