1.3.2 We undertake,if our Tender is accepted,to commence the work within the time stipulated in the Contract on receipt of the Owner’s written order to commence and complete the work specified in the Contract in within the time stipulated in the Contract.
1.3.3 We agree to abide by the terms and conditions of this Tender for a period of 180 (one hundred eighty) days from the date fixed for receiving the Tender,and it shall remain binding upon us and the Owner may accept it at any time before expiry of that period.
1.3.4 And we further undertake that,in the event of acceptance of our Tender,we shall when called upon by the Owner,enter into and execute a Contract Agreement in the prescribed manner for the works and with such modifications as may be necessary.If we do not submit the Performance Bond and sign the Contract Agreement within the stipulated time the Owner shall have the right to forfeit the earnest money or security deposit whatsoever.
1.3.5 If our Tender is accepted,we shall,when required,provide the guarantee of a Bank to be jointly and severally bound with us in the sum equivalent to 10% of the Contract Amount for the due performance of the Contract under the terms of the Bond in the prescribed manner.
1.3.6 We hereby agree to abide by and fulfill the terms and provisions of the conditions of Contract Agreement,or in default thereof,to forfeit and pay to the Owner the sums of money mentioned in the Contract Agreement.We also understand that the Owner has the right to reduce,increase or change the scope of work at his sole discretion and any decision taken by him in this respect shall be final and binding on us.
1.3.7 We solemnly declare that we have noted the conditions of Contract to the effect that there shall be no change whatsoever in the rates of items entered in the Bill of quantities and the total Tender Amount under the Contract on account of any increase in the prices of materials,fuel,rates of wages,cost of transport,hire charges of equipment and plants,taxes and duties or any other component entering into cost of execution of the work and that we shall not make any claim for enhancement of rates while executing the Contract and thereafter.We also declare that we are fully aware of the site conditions and hereby submit this Tender being fully satisfied with the site conditions and the access facilities,and shall not make any claim whatsoever as regards limitations thereof.
1.3.8 We are submitting herewith the complete set of Tender Documents with all supplementary attachments,all duly and fully filled in,signed and stamped as per terms of the Instruction to Tenderer.
