2009年1月15日,中国人民银行副行长朱民在“个人破产法律制度与不良贷款处置国际研讨会”上表示,建立个人破产法律制度意义重大.他指出,目前我国个人破产法律制度尚未健全,建立个人破产法律制度对于保护金融消费者、维护金融机构健康运行、促进国家金融稳定、支持我国走“依靠内需发展”的道路以及促进宏观经济结构调整,都具有非常重要的意义.
个人破产制度的提起得到了许多法律学者的响应,由此可见在个人作为市场经济主体日益频繁地参与市场经济活动,面对更多经济风险的今天,只允许企业破产的法律制度已经远远不能适应中国社会经济的发展要求,构建中国的个人破产制度迫在眉睫.
