民事诉讼法律程序的良性构建和运作有赖于对诉讼程序自身的价值内涵在较为深入的认识,但由于受到“重实体轻程序”的司法观念影响,我国理论界和实务界显然没有平衡好程序与实体矛盾关系,主要是缺乏对民事诉讼程序的独立价值应有的认识和重视,这就必然使得我国目前的民事诉讼程序规范办欠缺一定的价值指引而不尽完善,这种状况亟待改观.本文就从充分认识和探析民事诉讼程序所应有的价值内涵出发,对司法实践中如何协调好程序和实体的矛盾关系以及在此基础上如何构建较为完善的民事诉讼法律程序等问题略陈管见.
