Exclusions:The parties agree that information shall not be deemed confidential to the extent that any of the Confidential Information furnished pursuant to Paragraph 1:
a.is or become part of the public domain without violation of this Agreement;
b.is known and on record at the receiving party prior to disclosure by the disclosing party;
c.is lawfully obtained by the receiving party from a third party;
d.is furnished to others by the disclosing party without similar restrictions to those herein contained as to the use of disclosure thereof;
e.is developed by the receiving party completely and independently of any such disclosure by the disclosing party;
f.is ascertainable from a commercially available product; or
g.is disclosed pursuant to the order or requirement of a government body,court or administration agency.
Upon any unauthorized disclosure of Confidential Information,the disclosing party shall immediately take all actions reasonably available thereto to recover such Confidential Information and to prevent any further such publication or dissemination.
