一般词典都将jail 和prison译成“监狱”,不加区分,但有的字典对它们作了区分,如《牛津高阶英汉双解词典》对jail的解释是“=gaol”,而对gaol的翻译是“监狱”,该字典对prison的翻译是“监狱；看守所”.《大英汉词典》也将jail译为“监狱”,对prison的翻译则是：1.拘留所、看守所；2.（尤指州政府及联邦政府的）监狱.《英汉法律词典》同样将jail译成“监狱”,而将prison翻译为“监狱、牢狱；看守所、拘留所”.那么,这两个术语在汉语里的功能对等词到底是什么呢?根据The Dictionary of Practical Law:
jail.A building used for the confinement of individuals awaiting trial,or who have been convicted of minor offenses.The term PRISON is sometimes used interchangeably with jail,but PRISON is usually the place where only those with long-term sentences are confined.
从这里可知,jail和prison的功能对等词不同,jail更接近中国的“看守所、拘留所”,prison的功能对等词则应该是“监狱”.
