In the field of crimination,it is a highly debatable issue that whether the circumstances of an individual crime and the motivation should take into consideration.Some people advocate that fixed punishments for each type pf crime are necessary to uphold justice.However in my opinion,it is arbitrary to criminate someone without a thought of the criminal motive.
Firstly,fixed punishment do have a deterring effect on society.If the criminals know they will be subject to a certain punishment,they will reconsider committing the crime.This deterring effect help to build social stability and safety through decline th rate of crime.
Secondly,since punishments were fixed,those criminals would not be able to convince the court for unguilt.This would stop the cunning crimials from escape their punishments.
But,let us think it over.Can a person killing in self-defense compared to a heartless muder?Can a person stealling to feed his starving children compared to a robber with drug addiction?The answers are obvious even they did the same crime.Thus,if we do not take the circumstances of an individual crime and the motivation in to account,the laws will be nothing but cold-hearted.
In my opinion,an intermediary position between both solutions is the perfect way to ensure justice and equity.We would not let a person with gulit escape and would not punish even a single innocence.Since there still lots of space for the laws to develop,our government should think more about human rights and give those who crime without intention a chance to turn to a new leaf.
