Stan is a busy salesman who frequently travels to promote his employer’s products.Being a loving husband,Stan wanted to give his wife a surprise grand 40th birthday celebration.To this end,he instructed Tom,an event organiser,to use the Glee theme song,“Don’t Stop Believing” as the theme for the birthday party,which should,at the same time,be packed with dancing and singing by professional dancers-cum-singers.Believing that the Glee theme would only be suitable for an 18th birthday celebration,Tom,without discussing the matter with Stan,decided that it was more appropriate to use the “Sound of Music” as the theme for a 40th birthday celebration.Furthermore,being a busy event organiser,Tom,having accepted the job and without informing Stan about it,decided to sub-delegate to Helen,a young budding event organiser,the task of putting up the decorations for the party.Apart from being an event organiser,Tom also owned a restaurant,which often catered food for various party events.He conveniently decided to make use of his own restaurant to cater food for Stan’s wife’s birthday party.
As it turned out,Stan was rather unhappy with what Tom had done and he seeks your advice on the following matters:
[a] the various forms of authority that an agent may be endowed with under the law of agency.
[b] the cause(s) of action that Stan may have against Tom.
