We,the buyer,agree that the terms of purchase and sale of the commodityshall be as per Contract N2
February 5th,2014 year between “A” represented byGeneral Director (as seller) and “B",represented by President Mr.C,(as Buyer).Beneficianesnamed below;
Buyer side beneficiary are acting strictly as our Agents and/orMandates and/or Intermediaries shall have no liability whatsoever towards the Seller and/or Buyer and their respective Agentsand/or Intermediaries,on account of default under the Contract by Sellerand/or Buyer.
Agents and/or Mandates and/or Intermediaries or theirOfficers,Partners,Directors and Employees shall not be liable under anytheory of Contract,strict liability,negligence,misrepresentation or otherlegal equitable theory for any loss of damage of any nature incurred by Buyerand/or Seller and their respective Mandates and/or Agents and/or Intermediariesin the performance of the Contract between Buyer and Seller.
Agents and/or Mandates and/or Intermediariesshall not be liable to Buyer and/or Seller and their respective Mandates and/orAgents or Intermediaries for any special,incidental or consequential(indirect) or contingent damages such as but not limited to loss of profit,loss of opportunity,loss of business,etc.
