摘要：行政指导作为一种非强制性、体现民主管理形式的行政行为,日益受到重视.但由于行政法学界对这一制度的研究还不够深入,对其性质和运作机理尚缺乏统一的认识,以致于这一制度在我国还很不规范,而且行政指导中的救济制度常常被忽略.因此,本文通过分析行政指导救济的必要性和理论基础,偿试着提出从权力机关救济、行政机关救济和司法机关救济三方面构建行政指导救济机制,改变对行政指导的救济机制缺乏约束力度的状况的若干设想.
